BRIDGEPORT - A Fairfield developer accused of sexually assaulting someone he knew will see his case go to trial, officials say.
Last month, prosecutors filed a substituted charge of fourth-degree sexual assault, a misdemeanor, in the case of Daniel Suozzi. He originally was facing the felony charge of first-degree sexual assault.
Attorneys were slated in June to argue a motion filed by the defense seeking the cellphone data of the alleged victim and five other witnesses named in the initial arrest warrant affidavit, as well as Uber data for two of the witnesses. Suozzi's attorney, Mark Sherman, filed the 14-page motion in February, and said the data would contradict the version of events presented in the arrest warrant affidavit.
The motion could have led to the substituted misdemeanor charge, which allowed for Suozzi to apply for accelerated rehabilitation. The program is for first-time defendants accused of lower-level offenses, and subjects defendants to certain conditions and monitoring for up to two years.
If Suozzi had been granted the program and successfully completed it, his case would have been be dismissed.
Attorney Michael Resnick, who represents the victim in the case, said his team met with the defense and Judge Charle Stango in his chambers on Tuesday. He said he objected to Suozzi being allowed to do the accelerated rehabilitation program.
Then, before the judge could rule on that, Suozzi's team withdrew the application, according to Resnick. The case will be moving forward to trial - which is now noted in court documents.
Suozzi was accused of sexually assaulting an acquaintance at his home after a day of partying on Memorial Day weekend in 2025. He was released on a $50,000 bond following his arrest in November.
A protective order prohibits Suozzi, a partner in a Westport development firm, from contacting the woman he's accused of sexually assaulting while the case is pending.
