A Houston-area man was sentenced to 45 years in jail after he was convicted of driving while intoxicated for the seventh time, according to Comal County officials.
Brian Cooper, 41, of La Porte, pleaded guilty in Comal County to a charge of driving while intoxicated with three or more convictions, according to Comal County court records.
Cooper "was punished as a habitual offender," as he had six previous driving while intoxicated convictions in Harris County, according to the Comal County District Attorney's Office.
Cooper was arrested on Oct. 29, 2024, after he was found asleep in his truck, parked in the northbound lanes of Loop 337 in New Braunfels, according to the Comal County District Attorney's office. Cooper woke up after officers knocked on his window and his truck rolled forward, striking a police vehicle parked in front of him, according to the district attorney's office.
There were two two alcoholic beverage containers in Cooper's truck, and he smelled of alcohol and staggered after getting out of the vehicle, according to the district attorney's office.
According to a blood test obtained through a warrant, his blood-alcohol level was 0.182 grams of alcohol per 100 milliliters of blood - more than twice the legal limit of 0.08. Cooper was "uncooperative and had to be restrained" during the blood draw, officials said.
