PORTSMOUTH — Pike Industries has agreed to pay a $100,000 civil penalty, with $15,000 suspended for two years, to resolve New Hampshire's claims the company violated hazardous waste management laws and administrative rules.
Most of the violations occurred at Pike's facility in Portsmouth, which is at 650 Peverly Hill Road, according to Attorney General John Formella.
The announcement of the penalty states Pike "operated hazardous waste-generating facilities without a certified hazardous waste coordinator, failed to provide required initial and annual hazardous waste management training, failed to maintain required records and notifications, and had deficiencies involving the labeling, inspection, storage, and management of hazardous waste."
Pike Industries' website states it operates quarries, aggregate crushing, and hot mix asphalt production facilities in New Hampshire, Maine and Vermont.
Formella said Pike has entered a consent decree. The suspension of $15,000 of the fine has a condition stating Pike must not violate RSA 147-A (state law regarding hazardous waste management) during the two-year period, as well as comply with all requirements, including emergency planning and quarterly reports.
"New Hampshire has clear requirements for how hazardous waste must be managed, tracked, stored, and disposed of, and companies are expected to follow them," Formella said in a prepared statement. "This resolution holds Pike Industries accountable. ... These requirements are in place to ensure hazardous waste is properly managed and to protect New Hampshire's residents and our environment."
Formella stated the New Hampshire Department of Environmental Services' Hazardous Waste Management Bureau and the Environmental Protection Bureau of the attorney general's office handled the case.
Pike Industries did not immediately respond to a request for comment.
